Terms and conditions of using StacjaMowa — Speech and Function Therapy Center services

General Provisions

These Terms and Conditions define the rules and conditions for using services offered by StacjaMowa — Speech and Function Therapy Center, operated by Edyta Bykowska (formerly Maciukanis), located at ul. Tytusa Chałubińskiego 1A, 80-807 Gdańsk, Poland.

Definitions

  • Center - StacjaMowa — Speech and Function Therapy Center
  • Patient - person using therapeutic services
  • Legal guardian - parent or guardian of a minor patient
  • Therapist - person authorized to conduct therapy, possessing appropriate professional qualifications
  • Services - therapeutic services offered by the Center
  • Appointment - single therapy session
  • Medical records - documentation maintained in accordance with the Medical Activity Act
  • Patient consent - voluntary, informed, specific and unambiguous consent to personal data processing and provision of medical services, expressed through active action (Art. 4 para. 11 GDPR)

Scope of Services

The Center offers the following therapeutic services:

  • Speech therapy
  • Neurological speech therapy
  • Sensory integration
  • Myofunctional therapy
  • Electrostimulation
  • Speech and neurological diagnosis
  • Professional opinion issuance

Appointment Booking Rules

  • Appointments are scheduled by phone at +48 737 394 377, through the contact form on www.stacjamowa.pl or by email: kontakt@stacjamowa.pl
  • Patient receives appointment confirmation via SMS, email or phone call
  • Reservation is considered final after confirmation from both parties
  • In case of inability to keep the appointment, patient/legal guardian is obligated to notify the Center in advance (minimum 24 hours before appointment)
  • Appointment cancellation should be documented (by phone with confirmation, via email)
  • Failure to confirm appointment cancellation or cancellation less than 24 hours in advance results in a charge of 50% of the appointment price
  • In case of no-show without prior cancellation, patient is charged the full appointment price
  • Appointment booking for patients under 16 years of age requires consent of legal guardian
  • Legal guardian is obligated to ensure patient's presence at the appointment

Appointment Cancellation

Patient (or legal guardian of patient under 16 years of age) has the right to cancel a scheduled appointment with at least 24 hours notice. Cancellation less than 24 hours before the scheduled appointment results in a charge of 50% of the appointment price. Failure to notify (no-show) results in a charge of full appointment price (100%). Cancellation can be confirmed by phone (+48 737 394 377) or email (kontakt@stacjamowa.pl). Waiver of cancellation fee for short notice is possible only in case of emergencies, patient or guardian illness, or other circumstances beyond patient's control.

Payments

  • Payment for services is made immediately after the appointment (before leaving the Center) or according to individually agreed contract
  • Accepted payment methods: cash, bank transfer, payment card (Visa, Mastercard), Blik, Przelewy24 and other electronic methods
  • Service prices are available in the current price list, available on www.stacjamowa.pl website and at the Center's office
  • Prices may change - changes take effect with 30 days notice

Patient Rights

  • Right to information about health status and therapy progress
  • Right to access medical records and receive copies
  • Right to express consent or objection to proposed therapy methods
  • Right to medical confidentiality
  • Right to submit comments or suggestions regarding service quality
  • Right to withdraw consent for personal data processing at any time
  • Right to access personal data and request its correction or deletion

Patient Obligations

  • Punctual arrival for appointment
  • Providing truthful health information
  • Informing about any changes in health condition
  • Following therapist's recommendations
  • Performing recommended home exercises
  • Settling payments for services rendered

Center Obligations

  • Providing services with due diligence
  • Individual approach to each patient
  • Maintaining professional confidentiality
  • Maintaining medical records
  • Informing about therapy progress
  • Complying with personal data protection regulations

Medical Records

The Center maintains medical records for each patient in accordance with the Medical Activity Act and implementing regulations. Documentation includes: patient identification data, medical history, visit notes, medical recommendations, specialist opinions and copies of certificates and referrals.

  • Medical records are stored for the period required by law, not less than 20 years from the last visit (in accordance with the Medical Activity Act)
  • Patient has the right to access their medical records and receive copies (paper copy, electronic copy or photocopy)
  • Copies of medical records are provided upon written request by the patient or their legal representative (request can be submitted in person, by email or by phone)
  • Copies are issued within 7 business days from request date
  • The Center may charge a fee for issuing copies not exceeding administrative costs (not more than 50 PLN for first 100 pages, 0.50 PLN per page above 100 pages)

Data Protection

Detailed information regarding personal data processing is available in the Privacy Policy on the Center's website.

  • The Center processes personal data in accordance with GDPR regulations and the Medical Activity Act
  • Medical data is processed solely for purposes related to providing healthcare services
  • Patient has the right to access, correct, delete or limit processing of their data
  • Patient may withdraw consent for personal data processing at any time
  • The Center may share personal data and health information with doctors or other specialists cooperating with the practice, solely to the extent necessary to ensure continuity and effectiveness of treatment

Cooperation with Other Specialists

To ensure comprehensive therapeutic care, the Center cooperates with other medical specialists, in particular orthodontists, neurologists, laryngologists, pediatricians, dentists and other speech therapists and therapists.

  • Cooperation with other specialists takes place only with expressed, written consent of the patient or their legal representative
  • The Center may share medical records and health information with cooperating specialists solely to the extent necessary to ensure continuity of treatment
  • Before sharing documentation, the Center confirms patient consent
  • All information shared with cooperating specialists is subject to medical confidentiality

Liability

The Center provides services with due diligence, in accordance with current medical knowledge and best therapeutic practices. The therapist relies on knowledge available at the time of providing services.

  • The Center is not liable for lack of therapy results arising from: patient's non-compliance with therapist's recommendations, failure to perform recommended home exercises, patient's health conditions (which therapy cannot completely change), patient's interruption of therapy, patient's decision to change treatment plan or switch to another specialist
  • The Center's liability is limited to the value of services provided
  • The Center is not liable for side effects or indirect losses
  • The Center has professional liability insurance for medical practice (policy covers compensation up to the amount specified in the policy)
  • The Center is not liable for consequences of patient's decisions regarding: interruption of therapy, discontinuation of therapy, non-compliance with recommendations, continuation of therapy with another specialist

Terms Changes

The Center reserves the right to make changes to these Terms. Changes take effect from the date of their publication on www.stacjamowa.pl website. Changes to mandatory elements of Terms (prices, payment procedures, cancellation conditions) take effect with 30 days notice. Patients will be informed about significant changes via email, SMS, phone or announcement on website and at Center's office. Continued use of Center's services after announcement of changes is equivalent to acceptance of changes.

Complaints and Appeal Procedure

Patient has the right to file a complaint regarding the quality of services provided. Complaints can be submitted orally at the Center's office (with note in documentation), in writing sent by email: kontakt@stacjamowa.pl or by traditional mail: StacjaMowa, Tytusa Chałubińskiego 1A, 80-807 Gdańsk. Complaint should contain description of the problem, date of incident and patient contact information. The Center processes complaints within 30 days from the date of submission. Patient will be notified of the results via email or phone. If patient is not satisfied with the Center's handling of the complaint, they have the right to file a complaint with the Provincial Sanitary Inspector appropriate for the place of service provision or initiate court proceedings.

Final Provisions

These Terms are governed by Polish law. Matters not regulated in these Terms are governed by applicable Polish law, in particular: Civil Code, Medical Activity Act, Patient Rights Act and Patient Ombudsman Act, GDPR Regulation. All disputes arising from these Terms and their execution are subject to the jurisdiction of courts appropriate for the Center's location (District Court in Gdańsk). These Terms are available on www.stacjamowa.pl website, at the Center's office (for review and upon patient request for taking) and upon request sent by email.
